On Thursday, March 19, 2015, the U.S. Food and Drug Administration (FDA) released a Small Entity Compliance Guide for the Final Menu Labeling Regulation published on December 2014. The compliance guide is intended to assist small businesses. The guidance represents FDA’s current thinking on the Final Menu Labeling Rule. The guidance may be found here. Restaurants, supermarkets, convenience stores, supercenters, and other covered entities must comply with the Final Menu Labeling Rule by December 1, 2015. The Final Menu Labeling Rule imposes sweeping new labeling and recordkeeping requirements. FDA has indicated that it intends to release further guidance on the Final Menu Labeling Rule in the future, as well as a small entity compliance guide for the Final Vending Labeling Rule.
