On Friday, April 29, FDA released final guidance on the Final Menu Labeling Regulation.   The guidance addresses a number of key questions the food industry posed to FDA and provides a number of insights into FDA’s views on compliance requirements.   Please see this Lieberman PLLC Regulatory Alert which highlights some of the key points in the final guidance.  Note that this means under current law FDA can begin enforcement of the regulation on May 5, 2017.  Congress had prohibited FDA from using funds to enforce the law until one year after the date final guidance was released.  The effective date of the Final Rule remains December 1, 2016 however.  Even though FDA is prohibited from using funds to enforce the rule on that date, compliance is still technically required on December 1.  Please contact Erik Lieberman at erl1@liebermanpllc.com or 202.830.0300 if you have questions or would like additional information.
